The Cass County Planning Commission on Monday advanced a proposed temporary moratorium on new data center projects, moving the matter to the County Board of Commissioners for a final decision.
The vote at the county fairgrounds event center was met with applause from residents in attendance. The moratorium would pause approvals for new facilities while local zoning and environmental standards are refined.
What the proposal would do
Under the commission’s recommendation, any new data center development would be restricted to industrial-zoned land. In addition, developers would be encouraged — where feasible — to use closed-loop cooling systems instead of continually withdrawing fresh water. Larger "hyperscale" projects would need to submit megawatt build-out plans and demonstrate they would not cause significant environmental harm before receiving approval.

Community concerns and commission reaction
During public comment, residents raised concerns about potential water consumption, increased power demand, noise and broader environmental impacts. Several speakers questioned whether the local benefits justified the potential costs.

The line came from Terry Tilson of Plattsmouth, who voiced a concern echoed by others at the meeting.
George Tesar Jr., the lone commission member to vote against advancing the moratorium, told colleagues afterward that it was time to decide and that the recommended regulations would work. The commission, however, concluded it needed more time to resolve zoning questions and added the moratorium to the set of proposed rules before forwarding them.
If the Board of Commissioners approves the measure, Cass County would become at least the 12th Nebraska county to impose a temporary hold on data center approvals while local standards are developed.
